1. Who We Are
Diamonds Direct Winelands (Pty) Ltd is a company registered in the Republic of South Africa, operating the online store at shop.ddwinelands.com (the Store). We source and supply certified lab-grown and natural diamonds, delivered directly to you in our own branded packaging from the Cape Winelands.

2. Acceptance of Terms
By accessing our Store, placing an order, or completing a purchase, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in full. If you do not agree, do not use the Store or place an order. These Terms are supplemented by our Privacy Policy, Shipping Policy, and Returns Policy, each of which forms part of the agreement between us.
3. Applicability of South African Consumer Law
Where you are purchasing as a consumer resident in the Republic of South Africa, your rights are protected under:
- The Consumer Protection Act 68 of 2008 (CPA) - governing fair dealing, product safety, warranties, and your right to return defective goods.
- The Electronic Communications and Transactions Act 25 of 2002 (ECTA) - governing electronic contracts, disclosure, and your right to cancel within a cooling-off period.
- The Protection of Personal Information Act 4 of 2013 (POPIA) - governing how we collect, store, and use your personal information.
Nothing in these Terms limits, excludes, or waives any right you have under applicable South African law. Where any provision conflicts with a mandatory provision of the CPA or ECTA, the applicable legislation prevails.
4. International Customers
If you are purchasing from outside South Africa, these Terms are governed by the laws of the Republic of South Africa. By placing an order, you agree to this governing law and to the exclusive jurisdiction of the South African courts, subject only to mandatory consumer protections in your country of residence that cannot lawfully be excluded.
We currently accept orders from: South Africa, United Kingdom, Ireland, United States of America, Canada, Australia, New Zealand, Namibia, Mauritius, and Japan. Orders from other countries may be declined at our discretion.
5. Products
5.1 Diamond Type and Certification
We sell both lab-grown diamonds and natural diamonds. Each product listing clearly indicates which type is offered. Lab-grown diamonds are physically, chemically, and optically identical to natural diamonds but are created in controlled laboratory conditions rather than mined from the earth. All diamonds are accompanied by a grading certificate from a recognised gemological laboratory (such as GIA, IGI, or equivalent) as specified in the product listing.
5.2 Product Descriptions
Product images are representative and may differ slightly from the actual stone due to photographic lighting, screen calibration, and natural variation. Carat weight, colour grade, clarity grade, and cut grade are as stated on the accompanying certificate and take precedence over any image.
5.3 Availability
All diamonds are subject to availability. Stock is not guaranteed until your order is confirmed in writing. If a diamond becomes unavailable after your order is placed, we will notify you promptly and offer a full refund or an alternative stone of equivalent specification.
5.4 Pricing
All prices are in South African Rand (ZAR) unless otherwise stated. International customers may see an estimated price in their local currency for reference only - the transaction will be processed in ZAR at your bank's exchange rate at the time of settlement. Prices are inclusive of VAT where applicable to South African residents. VAT is not charged on exports to international customers, but you remain responsible for any import duties, customs taxes, or levies imposed by your country of residence.
6. Ordering
6.1 How an Order Is Placed
When you click "Complete order" at checkout, you are submitting an offer to purchase. No contract of sale exists until we send you a written order confirmation by email. We reserve the right to decline any order at our discretion.
6.2 Order Confirmation
Your order confirmation email will include: your order number, a description of the item(s) ordered, the price paid, your delivery address, and an estimated dispatch timeframe. Keep this email - it is your proof of purchase.
6.3 ECTA Cooling-Off Period (South African Customers)
In terms of section 44 of ECTA, South African consumers have the right to cancel without reason or penalty within 7 (seven) business days of receipt of the goods, provided the goods are returned in original, unworn, undamaged condition with all certificates and packaging intact. Return postage is borne by the customer. Refunds will be processed within 30 days of receipt of returned goods. This cooling-off right does not apply to goods that have been custom-made, engraved, resized, or otherwise personalised.
7. Payment
Payment is required in full at the time of checkout. We accept the payment methods displayed at checkout, which may include credit and debit card, instant EFT, and buy-now-pay-later options where available. DDWinelands does not store your full card details. By submitting payment, you confirm that you are authorised to use the payment method provided. Where a payment is declined or reversed after goods have been dispatched, we reserve the right to recover the outstanding amount and to take legal steps to do so.
8. Shipping and Delivery
Shipping terms, timeframes, zones, and costs are set out in our separate Shipping Policy, which forms part of these Terms. Risk in the goods passes to you upon delivery. Title passes to you upon receipt of cleared full payment. We ship using insured courier services. A tracking number will be provided upon dispatch.
9. Returns, Refunds, and Exchanges
Our full returns terms are set out in our separate Returns Policy. In summary:
- Unworn, undamaged items in original condition with all certificates and packaging may be returned within 30 days of delivery.
- Items that have been worn, damaged, resized, engraved, or altered are not eligible for return unless defective.
- Refunds are processed to the original payment method within 30 days of receipt of returned goods.
- Custom or personalised orders are non-refundable except where the item is defective.
Nothing in this clause limits your statutory rights under the CPA where goods are defective, unsafe, or not fit for purpose.
10. Warranties and Defects
10.1 Statutory Warranty (South African Customers)
In accordance with the Consumer Protection Act, all goods carry an implied warranty against defects for 6 (six) months from the date of delivery. If a defect is discovered within this period, you may: return the goods for a refund; have the goods replaced; or have the goods repaired. We will bear return postage costs where a valid defect is confirmed.
10.2 International Customers
Where you have mandatory defect rights under the laws of your country of residence that cannot be excluded, those rights are unaffected by these Terms.
10.3 What Is Not a Defect
Normal wear, scratches from use, damage caused by improper care or storage, and natural characteristics of a stone as described in its grading certificate do not constitute defects.
11. Limitation of Liability
To the maximum extent permitted by applicable law, DDWinelands's total liability shall not exceed the amount you paid for the goods giving rise to the claim. We are not liable for indirect, consequential, incidental, or special damages except where such liability cannot be excluded under the CPA or other applicable law. We are not liable for delays caused by circumstances beyond our reasonable control.
12. Intellectual Property
All content on the Store - including brand names, logos, photography, copywriting, and design - is owned by or licensed to Diamonds Direct Winelands (Pty) Ltd. The DDWinelands brand names and sub-brands (including Constance, Reclaimed, The Vintage, STRIK, INHLABA, and The Field Notes) are trading names and intellectual property of Diamonds Direct Winelands (Pty) Ltd. You may not reproduce or use any content from the Store for commercial purposes without our prior written consent.
13. Privacy and Personal Information
We collect and process your personal information in accordance with our Privacy Policy and in compliance with POPIA. By placing an order, you consent to the processing of your personal information for the purposes of fulfilling your order and, where you have opted in, sending you marketing communications. We do not sell your personal information to third parties.
14. Electronic Communications
In terms of section 11 of ECTA, you consent to receiving electronic communications from us in connection with your order. You may opt out of marketing communications at any time by following the unsubscribe link in any marketing email or by contacting us directly.
15. Accuracy of Information
You agree to provide accurate, complete, and current information when placing an order. DDWinelands is not responsible for failed deliveries or declined payments resulting from inaccurate information provided by you.
16. Store Availability
We make reasonable efforts to keep the Store available at all times but do not guarantee uninterrupted access. The Store may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
17. Changes to These Terms
We may update these Terms from time to time. The version published on the Store at the time of your order is the version that applies to that order. We will not apply material changes retrospectively to orders already placed.
18. Dispute Resolution
We encourage you to contact us in the first instance to resolve any concern. If a dispute cannot be resolved informally, South African customers may refer the matter to the National Consumer Commission (NCC) at www.thencc.org.za or to a relevant consumer tribunal. For international customers, nothing in these Terms prevents you from bringing a claim in your local courts where you have a mandatory right to do so.
19. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision shall be severed and the remaining Terms shall continue in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Returns Policy, constitute the entire agreement between you and DDWinelands in respect of your purchase.
